  • INTRODUCTION

     

  • Fair Fayre own and operate this website.
  • These T&Cs comprise a contract between you and Fair Fayre governing the use of this website.  Consumers’ statutory rights are not affected by this agreement.
  • Headings on the website are for information only and are not binding.
  • Fair Fayre reserves the right to update their T&Cs at any time without notification.  If you do not wish to accept these T&Cs you should not continue to use the site.
  • Your use of the Fair Fayre website signifies your consent to the collection, processing and use of personal information by us for the purpose of administrating and dealing with your order or account, market research, processing your payments, credit reference checking and fraud detection, and for marketing purposes as outlined below.

  • When you place an order with Fair Fayre, you agree to accept the following T&Cs.

    1. Fair Fayre's base currency is Great Britain Pounds.  All Euro prices are approximate based on an exchange rate of £1 = €1.1765 (£0.85 = €1).

    1. OWNERSHIP
      1. All goods are offered subject to availability.
      2. All goods remain the property of Fair Fayre until paid for in full.
      3. Acceptance of goods shall be deemed conclusive evidence of the buyer’s acceptance of these conditions.

     

    1. CANCELLATIONS & RETURNS
      1. We are confident you will be happy with your purchase.  However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible.
      2. If you are unhappy with one or more items, simply return them in the original packaging and we will give you a credit on those products or replace the item where possible. An email must be received by  Fair Fayre within 7 days of delivery.  In order to receive credit for damaged goods all goods must be returned within 7 days of delivery.  Otherwise you are deemed to have accepted the goods.  All such goods must be stored under appropriate conditions and be available for inspection.  No liability other than the value of the goods is accepted for non-delivery, or late delivery.
      3. You have the right to cancel your order over 24 hours before receipt without giving a reason.  Any refunds will be made within 30 days of cancellation.  Your statutory rights are not affected.
      4. When you submit an order online with Fair Fayre, that order or the quantity of goods on the order cannot be changed upon delivery of your order.
      5. Every effort is made to display only items that are in stock or which can be dispatched to you.  From time to time, Fair Fayre may be unable to meet our usual delivery times due to certain items being unavailable in which case we will advise you within 24 hours of the order being placed.  If this does occur, you will be given the opportunity to 1) order an alternative, 2) have the product sent as soon as it becomes available, or 3) cancel the order.

     

    1. COMPLAINTS
      1. If you have a complaint about our service or any goods you purchase from Fair Fayre, it must be received within 24 hours or delivery.
      2. All goods should be inspected on delivery and checked before a signature is given.
      3. All complaints will be dealt with in a fair and confidential manner.
      4. All account queries following an order should be notified before the Monday following your order delivery at which time all outstanding payments will be due.  If notification of a query is not received before this time, the monies due is deemed correct.

     

    1. PRICES & VAT
      1. All prices are quoted by default in Great Britain POUNDS STERLING (£) and where appropriate include Value Added Tax.  VAT will be charged on some products pending government regulations. 
      2. If a customer’s VAT number does not match the company registered with that VAT number, they will be liable to pay VAT where applicable.
      3. Republic of Ireland customers can view EURO prices by changing the default setting.  Prices are liable to change in accordance with currency fluctuations. 
      4. Fair Fayre makes every effort to ensure the prices are accurate however changes beyond our control do occasionally occur.  If this happens, Fair Fayre will contact you before shipping your order to gain your agreement to the revised price or alternatively to amend or cancel the order.
      5. You will receive a confirmation email within 24 hours of your order being placed.  This will include your order number, Fair Fayre’s contact details, a full list of the products you have ordered and all costs.  Fair Fayre accepts no responsibility for undelivered orders where a confirmation email has not been received by the customer.
      6. The price quoted is only effective if the T&Cs are adhered to and are only valid for the period stated.
      7. Every effort is taken to ensure that the information contained on this website is correct and up-to-date.  However, Fair Fayre disclaims all warranties and representations as to the accuracy of any information contained if at any time it becomes inadvertently out-of-date or incomplete.  Fair Fayre cannot be held responsible for any loss or damage that may arise from the use of this information.

     

    1. DELIVERY
      1. Delivery will only be directly to the door of the kitchen if it is on ground floor and hand trolley accessible; if not, there must be another area which is hand trolley accessible and on ground floor.
      2. Our delivery schedule can be referred to on the homepage for delivery days in each area we supply or length of time taken for an order to be dispatched.  If for any reason this changes or there is a delay, Fair Fayre will notify you as soon as possible.
      3. All delivery dockets must be signed and kept as proof of delivery.

     

    1. PAYMENT METHODS
      1. All new customers are required to set up an online account with us complete with customer details, payment method, and manageable via a personal username and password (A Bank or Director’s personal reference may be required).  If, for some reason, you lose or forget your details, these can be retrieved via use of the email address provided on your registration.
      2. You can choose not to provide certain information however this may limit your ability to take advantage of our features.  The information we require from you is for business purposes: responding to your requests, fulfilling orders, customising future shopping, improving our service & online store features, and communicating with you.
      3. We accept online payment in a secure environment by credit card.  We accept Visa, Mastercard, Delta, Maestro.  As we use worldpay, a reputable provider for processing online payments, Fair Fayre does not ever know your credit card details and thus we cannot retain them for future reference.  This security practice requires that payment details must be entered each time.
      4. Credit Card transactions will be completed on receipt of order dispatch.
      5. We reserve the right to ask customers to complete a credit application form at any time.
      6. For customers who require a Direct Debit account be set up, a Direct Debit mandate and Credit application form must be completed and returned to us at our address.  This may take up to 10 working days to process and business will be completed on receipt by Fair Fayre of satisfactory bank and trade references.
      7. If an account is established, all accounts are net weekly and payment becomes due on the Monday following delivery of your order.
      8. All accounts will be set with a credit limit, pending on our credit checks. All credit limits can be reduced if credit terms are broken.
      9. Fair Fayre has the right to stop deliveries if the T&Cs are broken.

     

    1. QUALITY CONTROL
      1. Fair Fayre is owned by Barbarrie Duckling Ltd.  Barbarrie Duckling Ltd runs an approved HACCP System and is also registered with the Local Environment Health Services.  Full details are available on request.

     

    1. PRIVACY POLICY
      1. We respect your privacy and are committed to maintaining the security and privacy of your information as you visit our on-line store and buy from us. The Fair Fayre web site is a UK-based website and is in accordance with the requirements of the UK Data Protection Act 1998 relating to the personal information you supply on the Site. The Site uses a security system that protects your information from unauthorised use. We will not sell, distribute or disclose information about you as an individual or your personal usage of the Site without your consent or unless required or permitted to do so by law.
      2. At Fair Fayre, in seeking to provide products and a service of value to you, we may use information from our interactions with you to help this process.  Accordingly, we make every effort to ensure your personal information is managed in a secure and responsible manner.
      3. As the Fair Fayre website continues to be developed to implement new technologies and improve the services and features we offer, we reserve the right to change this Privacy Policy from time to time without notice. For this reason, we encourage you to check the Privacy Policy each time you visit the site. By using the site, you agree to the terms of the Privacy Policy in effect at that time.

We do not rent, sell, or exchange account or personal information outside Fair Fayre and its associates for the purpose of independent telemarketing or direct mail marketing of any products or services.  We will only provide your information to reputable organisations solely for the purposes of helping us to fulfil your order.  For example, we use companies to verify and process credit card transactions, and to deliver goods ordered.  These third parties are not authorised to use your information for any reason other than to fulfil our service.

     

    1. INTELLECTUAL PROPERTY RIGHTS
      1. The content of our website including without limitation all information, software, data, text, photographs, graphics, sound and video are protected by copyright, trade marks, service marks, patents or other property rights.
      2. Except insofar as expressly permitted in these T&Cs, the content of this website may not be retrieved, displayed, modified, copied, printed, downloaded, sold, hired, reverse engineered or transmitted in any way without the prior written consent of Fair Fayre.
      3. You may retrieve and display the content on this website for your personal and non-commercial use only and in connection with any actual or proposed order by you on this website.
      4. You may not link to this website or copy detail from this website to another external website without prior written permission.

     

    1. COOKIES & OTHER COMPUTER INFORMATION / INSTABILITY OF THE INTERNET
      1. The internet is an inherently unstable medium.  Fair Fayre accept no responsibility in respect of external interruptions or errors.  Fair Fayre reserve the right to suspend the website without prior notice for repair, maintenance or other technical reasons.
      2. Our website sometimes uses cookies or other technologies to help us understand which parts of our websites are the most popular, time spent on pages, how it is being used and to provide features such as storage of items in your Shopping Cart between visits.  Fair Fayre reserves the right to use cookies and other technologies to study traffic patterns on our web site to help us provide a better service to our customers.  However, if you prefer, your browser software should enable you not to accept cookies which should not affect your ability to use our site. 
      3. Under normal circumstances, we do not use IP addresses to identify anyone, however, we may choose to do so in the event of identifying abuse, fraud, or illegal use of our web site or other unauthorised activities.

Without prejudice to the rest of these T&Cs, Fair Fayre’s liability of any kind including breach of contract, tort (including negligence) or otherwise with respect to this website or any goods purchased via this website shall be limited to the amount of any order to which the claim relates.
      3. In no event (including our own negligence) will Fair Fayre be liable for any:

                                                                   i.      Economic loss (including, without limit, loss of revenues, profits, contracts, business or anticipated savings);

                                                                  ii.      Loss of goodwill or reputation;

                                                                iii.      Special, indirect or consequential losses;

                                                                iv.      Damage to or loss of data with respect to this website (even if Fair Fayre has been advised of the possibility of such losses)

     

    1. GENERAL
      1. These T&Cs constitute the entire agreement between you and in connection with the use of this website.  Any failure by Fair Fayre to exercise or enforce any right or provision of these T&Cs shall not constitute a waiver of such right or provision.  If any part of this agreement is deemed ineffective for any reason, the remainder shall continue in full force.  A person who is not a party to this agreement shall have no right under the Contracts Act 1999 (Rights of Third Parties) to enforce any term of this agreement save in relation to disclaimer part 1.

     

    1. FORCE MAJEURE
      1. Fair Fayre is not liable for failure to perform or delay in performing any obligation (excluding payment) under this agreement if the failure or delay is caused by any circumstances beyond our reasonable control.
